This Refund and Cancellation Policy outlines the conditions under which a Client may receive a refund or credit for services provided by Celebrity Wings Entertainment (“CWE,” “we,” “us,” or “our”). Due to the unique nature of agency services, which involve significant non-recoverable upfront costs and commitments to third parties (Talent), our policy is structured around specific phases of service delivery.
1. General Principles
- Service Agreement Governs: This policy supplements, and is governed by, the specific terms detailed in your signed Proposal and/or Statement of Work (SOW) and the overall Terms and Conditions. In case of conflict, the SOW takes precedence regarding specific fees and timelines.
- Non-Refundable Costs: Fees related to executed third-party commitments (Talent, vendors, production costs) are generally non-refundable.
- Agency Fee: Refunds on the Agency/Management Fee are considered only based on the phase of the project and the scope of work completed by CWE.
2. Cancellation and Refund Schedule
Refund eligibility is determined by the stage of the Campaign when the Client requests cancellation in writing:

3. Refunds for Breach by Celebrity Wings Entertainment (CWE)
If the Client terminates the service agreement due to a material breach of the Terms and Conditions by CWE, the Client may be entitled to a pro-rata refund of the Agency Fee for the services not rendered, provided:
- The Client notifies CWE in writing, detailing the breach.
- CWE fails to cure the breach within the cure period specified in the Terms and Conditions (e.g., 30 days).
- The refund will exclude all Talent Fees and non-cancellable Pass-Through Costs incurred prior to the termination date.
4. Refunds for Talent Non-Performance (Talent Breach)
CWE acts as an intermediary. While we strive for professional execution, we cannot guarantee the Talent’s specific actions, content quality, or fulfillment of obligations after the contract is signed.
- If the Talent materially breaches their contract (e.g., fails to post content without a valid reason, violates a key contractual clause), CWE will, at the Client’s direction:
- Attempt to negotiate a resolution with the Talent, including potential content replacement or a partial/full refund from the Talent’s side.
- CWE will pass through any refund amount recovered from the Talent directly to the Client.
- CWE’s Agency Fee related to the non-performing Talent is Non-Refundable, as CWE successfully delivered the service of securing and contracting the Talent as requested.
5. Chargebacks and Disputes
If a Client initiates a chargeback or payment dispute without first utilizing the cancellation procedures outlined in Section 2 or the dispute resolution process in the Terms and Conditions, CWE reserves the right to:
- Immediately suspend all services.
- Pursue collection of the full contract amount, plus any fees or penalties incurred due to the chargeback.
6. Processing Refunds
- All cancellation requests must be made in writing via email to [Your Designated Billing/Cancellation Email Address].
